A federal judge denied the Trump administration’s bid to dismiss activist Mahmoud Khalil’s challenge to his arrest by Immigration and Customs Enforcement (ICE) agents and has decided to shift the jurisdiction of the case to the state of New Jersey.
Khalil, a Palestinian who completed his studies at Columbia University in December, will remain in the US for the time being.
In his order on Wednesday morning, district judge Jesse Furman explained that, given the fact that Khalil was in detention in New Jersey at the time his lawyers submitted their petition, it meant that the New York court he presides over “lacks jurisdiction over most, if not all, of Khalil’s claims”.
Just to be clear, this cowardly judge is basically just dodging responsibility, likely out of fear for themselves.
Khalil was illegally kidnapped by ICE - a federal agency.
But he won’t be free.
Why is this qualified as for now… He’s legal resident
citizenand he has first amendment protection the government can’t deport him for the things he says. He’s not a citizen, he’s a lawful permanent resident (has a green card).
Citizens go through the naturalization process. Green card holders have not done so, and retain citizenship of a different country than the USA.
Yep you are right I will amend my statement to clarify that he is a lawful resident eligible to become a citizen.
Rest of the point stand.
Even those here undocumented are supposed to have those protections. That we’re already to THIS point should terrify people.
